The overall point seems to be that if you’re paying for loot boxes with randomized prizes, that’s enough, and would be included in whatever regulations are put in place. Still, if we’re talking about legislation, I’m not sure what legal bearing pay-to-win or loot-box-to-progress systems would have that would mean they’re treated somehow differently than say, Overwatch’s cosmetic loot boxes. You feel you almost need to buy boxes (or grind crazily) to keep up. Purchased or “earned,” they are the only way to progress. You can’t just ignore the “store” section, loot boxes are directly integrated into multiplayer progression.
